Model X Founder Series - Facts part 2

Spoke today with my delivery specialist and my FbR Model X is about to enter production at the factory. He now says that FbR will be mixed in with the Signatures. That may mean early January is my speculation.

No delivery or in production notice yet, but I noticed that in My Documents on the Tesla site there is now a document "MX Program Referral" that has the updated invoice. Total $144,950 and then a $28,250 credit, net $116,700 (same as production P90D with delivery fee). I don't understand why they keep insisting that taxes will be based on the total amount before the credit ($8,697 based on my 6% rate).

However an equivalent production P90DL would be $151,450, so the "true" savings are $34,750.

I found the updated invoice too. I wish they just discounted our car according to our referral credit. Other car manufacturers discount their cars all the time and it is not unusual to have a $30K discount on cars that cost six figures. I am sure Tesla is still making a profit off our cars too.

It's not a rebate, it's a discount...... they can't charge sales tax on it.... I got $29k off my P90DL as part of the referral program ($24k for referrals and $5k for inventory car), and sales tax was taken on the amount I paid for the car....
  • Dec 21, 2015
    Marcus Adolfsson
I guess it is up to Tesla if they want to treat it as a "rebate" or "discount" (confusingly the paperwork shows it as a credit) - but I feel they should pick the option that is most beneficial for the buyers.

Separately I have 9k left in Tesla credits that I can't apply to the X, not sure what to do with it. Already bought a winter tire set for a friend and a wall charger.

My DS has been advocating on my/our behalf for a few days on this issue. The standard price for a founder's edition is 115.5k. We won the right to buy a founder's edition. It's not a rebate or a discount. We're paying the standard price. We should not have to pay sales tax on an inflated amount. In VA in addition to sales tax we pay an annual personal property tax based on the residual value. If Tesla maintains this position it's going to cost me a lot more. We were planning on getting a 90D and not the P90D, and with the additional tax the benefit to me from the program is essentially nullified. Please Tesla do the right thing here.
  • Dec 21, 2015

MSRP on the Founder edition appears to be the same as the Signature edition: $132,000 to start plus up to $11,750 for Ludicrous, Cold Weather, and Towing. You won the right to buy a fully loaded Founder edition for the price of a base model P90D, but that does not make it the standard price. Historically everyone has paid MSRP for Teslas, and only since the referral program has this begun to change. Tesla may not yet fully understand how to handle these discounts.

When buying a car from a conventional dealership, there are two numbers that matter when determining how much tax you pay. Since hardly anyone pays MSRP, the dealer must first come up with an agreed upon sales price that establishes the taxable value of the vehicle. Any discounts or rebates offered by the manufacturer are then subtracted off this price but are considered taxable. Here is where things get confusing with Tesla. Since they are acting as both the manufacturer and dealer, are they agreeing to sell you the car for $115,500, or are they giving you a $28,250 discount? The way they worded the referral program may have implied the former, but tax laws written around franchised dealers could force the latter. Good luck with your argument, but I could see it going either way.

Does anyone have a guess as to which color seats Mark (Founder #3) has in his MX? iCloud Photo Sharing
It looks too light to be black, and too dark to be tan. I would say it looks gray, but based on the discussion here, it looks like Founders models have same upholstery config options as non-Founders.

They are black. With light shining directly on them they may appear to be lighter, but that is just an optical illusion. Tesla only offers 3 colors of seats on Model X - white, tan, and black - and Founders are no exception.

While I cannot say with complete assurance, given that we have generated a VIN for your Founders Model X I suspect that it has reached the production queue. So, I heard back from my DS. Unfortunately, the news is disappointing; Tesla is going to list the MSRP for the the FbR cars as 132k, and then add the cost of the options you select at standard pricing. This will be the selling price, and all taxes and registration fees will be based on this amount. A referral program credit will then be applied, equal to an amount to leave the remaining balance as 116,700 including the $1200 doc and transport fee.

I provided feedback to my DS to pass up the food chain that it was a disappointing outcome, and imho, Tesla could have done a better job thinking through how these transactions would be accounted for before they announced the referral program, and provided better transparency via the program's terms and conditions. While inadvertent, Tesla needlessly soured the experience for some of its' most prolific supporters.

I'm going to leave it at that.

    Cheers...

The "good" news with this arrangement for us that are financing, is that the loan ratio will be based on the sales price ($144,950 in my case). Instant 20% down means one can finance 100% of the cash due.

You can get 100% financing from many banks and CUs. Alliant, for example. You might be able to forego gap insurance though, if you don't buy replacement coverage from your insurance company.

Telsa is funny in that it harnesses it's influencer community in a referral program like this, but then treats them roughly. I was pissed that I couldn't use my $17K in referral credit on almost anything except a new Model S. HELLO TESLA, I already have a Model S and just qualified for a FbR Model X so why design a program that can only be used with purchase of yet another car!!!!! But even after elevation to Ian, Project Manager for NA, the final answer was that referral credit could only be used on one car, the Model S. Silly that they should even care where the credit was used, but I will soon own three Teslas.

The influencer community is used to being pampered a bit and certainly treated with respect. How do you think we are able to sell so many cars for Tesla? Folks respect our opinions.

Tesla however could care less about us after they get they get our referrals. If I were cynical, I would say that this was by design as participation in the referral program got me buying two more cars from them at prices above their cost. Nice to have an incentive program that makes money off your influencer salesforce.

It's funny, but on the official forum a winner of a new Model S under the program was not going to pick-up his car after going through the unfavorable tax positioning of Tesla. He said Tesla fixed the problem and that thread quickly disappeared. Pretty embarrassing when you have a referral program where the winner doesn't even want first prize!

So you receive a free Powerwall w/installation, $17k in credits, and a substantially discounted fully loaded Model X. I can see why you're so unhappy.

Was it originally unclear? Yep. Do I still feel like I've received a great deal? Yes, HELL yes. I honestly don't understand all this complaining.
  • Dec 22, 2015
    g-force
Ditto Bonnie although t would have been nice to use referral dollars towards X purchase!
  • Dec 22, 2015
    Reeler
All good perks, but it requires spending $200K to fully benefit from them. If they allowed applying the credits for the Model X, I would only have to spend $100K to use the benefit. I typically pay cash for cars so YES spending $200K somewhat unexpectedly is a PITA.

My main complaint in line with others is that Tesla lacks empathy toward their most ardent supporters who are helping them tremendously with their sales efforts. How hard would it be to just call the referral credit a discount on MSRP so that extra tax is not owed? Why not allow the credit to be applied to Model X? Why not allow the credit to be used on a service contract or online merchandise?

They promised "to be fair and reasonable" and in my opinion that is lip service. Sure I appreciate the program, but their complete inflexibility is inconsistent with their terms and the brand generally.
  • Dec 22, 2015
    bonnie
Wait, huh? It will cost you $200k unless you can use your $17k to reduce it to $100k? I'm having a hard time making sense of that, because math.
  • Dec 22, 2015
    Reeler
We own a Model S. That is how one qualifies for the referral program. Once they lifted the limit of 10 referrals, many accumulated large amounts of credit that will expire in 12 months. I don't need a charging station or rims, so if I added up every accessory possible for my Model S, I get to $4500 of possible spend. So there is no way to spend that money without buying another car.

Great, I get a FbR Model X at my level of referrals so problem solved, but NO use on the purchase of a Model X is not allowed although unclear in the terms of the program. $115K to buy the Model X, plus extra tax so I am at $120K. Even if I bought accessories for that, I still cannot burn the $17K. So I am buying another Model S for $80K or so.

Now, we might sell the car we like the least or use one for my business. Not sure, but my situation is pretty typical for the best participants in the program.

    - - - Updated - - -

Others are doing hokey things like buying adapters, rims, etc. and reselling them to recoup some cash. I'm sorry, there should be logical ways to spend the benefit of a good referral program without resorting to buying two cars or setting up a store on eBay.
  • Dec 22, 2015
    bonnie
Actually, one qualifies for the referral program if they own ANY Tesla vehicle (Roadster or S), or have configured/confirmed a reservation for S or X.

I guess I would have bought the new S using credits & flipped it for a profit. Then I'd take that same money and apply towards the X. Or another option would have been to trade in the existing S, use your credits, and upgrade the car. You also end up with the $7500 tax credit. But doesn't matter -- no matter what scenario it is, it doesn't end up costing you $100k if you can't apply your $17k credit to an X.

I *only* have $13k in credits. And I'm not worried about how to spend it ... chademo, extended warranty, HPWC, service plan, set of winter tires.

You clearly feel like you were done wrong & I'm sorry you feel that way. I'm thrilled over how it turned out, personally. That's why I don't get why you're upset.
  • Dec 22, 2015
    Reeler
The second program was opened to reservation holders, not the first one. None-the-less, the participant has a car already.

Yes, flipping a car could be done, but the Federal and my state tax break does not allow that do be done and claim the credit.

I believe you cannot use the credit on the service plan. Go through the math and with a single car, you cannot spend $13K with Tesla. Now I think you have more than one Tesla so it might be possible. If not, plan on flipping product on eBay or whatever.

But, that is all besides the point. Tesla should have a little flexibility, especially were the program was ambiguous, and they promised to be fair and reasonable.
  • Dec 22, 2015

I'll choose to remain happy about all the free stuff I received for doing what I was doing before the program. It all feels like a bonus to me. I understand others feel differently. Best of luck to you, hope you figure it all out.

I was quite pissed off when I found this out myself. Being a Model S owner got you into the referral program. With a FbR Model X at 10 referrals you have to take that deal. To use my $17K in referral credit I found buying a Model S was the only way to get rid of the credit without reselling shenanigans. Now I will have three Teslas for our two drivers. Kinda maniacal of Tesla since they sold two additional cars to me and made profit on both!

I was the one that elevated the issue to Ian who is the N. American Program Manager. In a heated and long conversation, he would not budge. Silly to design a program that requires shenanigans like selling stuff you buy to take advantage of it. Poorly thought out in my opinion if your best participants have no straight forward way to get their prizes.

That is why I started another thread to provide feedback to Tesla if they should renew the program: http://www.teslamotorsclub.com/showthread.php/60051-Tesla-Referral-Program-REDESIGN-Post-Your-Suggestions-to-Help-Tesla-Sell-More-Cars

  • Jan 7, 2016
    Reeler
It said you could use the credit to buy a car. Later it said that the credit couldn't be used to RESERVE a Model X.

I interpreted this to mean that I had to pay for the $5K reservation, but could use credit to pay for the remainder of the Model X.
  • Jan 7, 2016
    andrewket
We probably should move this to a different thread. Any mods around?

For what it's worth, this ^^^ was my original interpretation as well. IMHO Tesla didn't take sufficient care and time when creating the program's terms and conditions. I thought the use of the word "reserve" rather than purchase was odd. Therefore, there had to be a reason - and I came to the same conclusion you did. They wanted real money to be used for the non-refundable deposit, but the credits could be used towards the purchase.

With a Model X in Denver in Jan 2016, wherever you bring it, you will have a car show. ;) As a Denverite eagerly awaiting viewing an X in person so we can configure ours, I'll bring the food or drink of your choice if you decide to show yours off.

Pearl with the white seats/black headliner. The plastic bags over the seats make them look more tan.

Congrats on the upcoming deliveries on "Founders by Referrals". Mine has been "in production" for 2 weeks with no updates at all. I wonder if Sig red is holding it up? Any sig reds founders by Referral x shipped?

Glad to hear I'm not only one. It's been 3-4 weeks in production.

I think its something else. Mine is still only confirmed on MyTesla. But My guy says its on the truck {sig red} and continues to not know for sure delivery date. Wonder if we are on the same truck.

But today got MVPA. Funny it had an error where they left off the ref bonus but the bottom line was the right number. Little math problem. Has been corrected.
Also of note the doc says delivery on or about 1/22. (we think its there already...)(inspection ya know ...)

Mine is still at the factory. Also, the website isn't updated for sigs or founder's. It will say confirmed until you take delivery.

Thanks Marcus, the MX next to your pictures are my signature. I have been frustrated with the Orlando SC for poor communication and seeing your thread I emailed my DS to receive..."Hi Arnie...guess what? We were just about to reach out to you today because your Model X has JUST arrived at our Orlando Tesla Store!!!" They say I can pick it up Tuesday 1/19
Good luck on your experience...maybe we will meet at the club meetings.

@Reeler let me know if ever you have an X to model in Denver, as I too am waiting for the park meadows store to get an X to show off, which they hope to occur in March. Also the DS on Evans will not allow any prepped delivery of an X to be shown off, privacy thing they said to me last week. Ugh. I just heard they store deliveries at the abandoned Safeway at Leetsdale/Quebec, but I don't drive that area enough to wander over just for grins...jsollender

Today we called. We saw her in the center on Sat. Advised they are shorthanded on X Xperts and the MXs require a lot of time for the inspection. And there may be a one or two ahead of me. And if it needs parts ... !!! So end of the week best, maybe next week delivery.

Are the recent Founders deliveries through the referral program? Or did they produce a big bunch of Sigs before all of the original Founders editions went out? Just curious about the production pipeline.

Yes, all recent deliveries (about vin 50 and up) are through referral program. They built our cars at the same time as sigs.

Well, those of us who have configured. I'm waiting a lil bit. I'll be known as The Last Founder.
